DATA PROTECTION AND COOKIES POLICY

· "PIERRE & VACANCES CENTER PARCS Group" refers to all the legal entities that operate the following brands: Pierre & Vacances, Pierre & Vacances Premium, Pierre & Vacances Villages Clubs, Maeva, Aparthotel Adagio, Aparthotel Adagio access, Center Parcs, Sunparks, Pierre & Vacances Property Investment, Center Parcs Property Investment, Les Senioriales, Village Nature, La France du Nord au Sud, Clubhotel Multivacances.
· "Personal Data Processing" refers to any operation or set of operations that is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
· "Personal Data File" stands for any structured and stable set of personal data that can be accessed according to specific criteria, whether it is centralised, decentralised or dispersed on a functional or geographical basis.
· "Partner" stands for a third-party company with which the Controller that collected the data has signed an agreement to make the data available for processing for the benefit of said third party company; these companies may send you additional proposals for subscribing to commercial offers, to the extent allowed by law.
· "Service": means a service proposed by an entity of the PIERRE ET VACANCES - CENTER PARCS Group or any of its partners.
· "Company": refers to the entity of the PIERRE & VACANCES CENTER PARCS Group whose contact information is given in the Particulars as publisher or issuer of the data collection form.
· "Site": refers to a website of any of the entities of the PIERRE & VACANCES CENTER PARCS Group.
ARTICLE 2 - SCOPE OF APPLICATION
To supplement their core business activities of tourism and real estate, or to fulfil their objectives, certain entities of the PIERRE ET VACANCES - CENTER PARCS Group may engage in the e-commerce business.
ARTICLE 3 - Personal data processing
The Controller may gather data relating to You, in connection with the operation of its Site.
a) Legal basis of processing
The processing relies on (i) the consent given by the data subjects; or (ii) (a) the setting up and performance of a contract; or (b) measures at the request of the data subject that are taken prior to entering into a contract; or (iii) the necessity to satisfy the legitimate interests of the PIERRE ET VACANCES - CENTER PARCS Group.
b) Purposes
· (i) Where the User or the Client has given their consent, their personal data will be collected and processed for the following purposes:
- Send information newsletters and e-mailing at no cost, and measure the click rate on the links given in the newsletters,
- Respond to information requests from Users, notably regarding timeshare allocation companies,
- Be contacted by a client manager based on the contact information and other information You have entered,
- Draw up statistics and measures of Services access frequency;
· (ii) In the context of the performance of a contract or where measures are taken prior to a contract at the data subject's request, personal data will be collected and processed for the following purposes:
- Track the vacation periods and destinations entered;
- Process the payment of the reserved vacation period;
- Carry out measures prior to a contract such as providing advice, issuing estimates, etc.;
- Carry out management actions and subsequent performance of the purchase contract for units or shares in the timeshare allocation companies for the enjoyment of the requested period;
- Create a Clients file for monitoring and delivery of the services by the entities of the PIERRE ET VACANCES - CENTER PARCS Group or its processors and third parties in charge of delivering the promised service;
- Conduct client satisfaction surveys after a stay;
- Contact point for a client relationship officer.
· (iii) In the context of its legitimate interests, the Controller will collect and process personal data to ensure continuity of service and to sustain the business activity of the PIERRE ET VACANCES - CENTER PARCS Group entities:
- Any other purpose that seems legitimate, provided that it safeguards fundamental rights and freedoms.
a) Data processed
Prior to the data collection, the User will be informed about whether it is mandatory or optional to provide the requested personal data.
The data marked with an asterisk in the registration or data collection form is required. If this data is not provided, it would be impossible for the data subject to access and use the Services, or it would not be possible to respond to a request relating to a form.
The other data is optional and not providing it would not disrupt the delivery of the promised services or responses to information requests, although it could limit their relevance.
In particular, the PIERRE ET VACANCES - CENTER PARCS Group entities are likely to collect the following data from You:
- Identity: name, first and middle names, address, telephone number (landline or mobile), email address, postal code, birth date, internal processing code that serves to identify the client (the internal processing code is not the same as the registration number in the national system of identification of natural persons, the social security number and the bank card number);
- Data linked to means of payment: bank account or post office account details, transaction number, cheque number, bank card number, third party financing;
- Business relationship data: documentation requests, requests for information on products, quantities, amount, frequency, purchase history, correspondence with the client;
- Payment data: payment arrangements, discounts granted, information on loans taken out (amount and period, name of the lending organisation), receipts, unpaid dues, reminders, balances;
- Contact data: exchange of correspondence, messages date and time;
- Data regarding registrations to newsletters: name, first name, email address;
- Traffic statistics: IP address, cookies, for example, the pages viewed by the user, date and time of such viewing (see details on cookies below);
- Any other personal data entered spontaneously in the contract request form (enter only relevant information - destination, period, characteristics of the accommodation searched, etc. - to respond to your request).
GPS-tracking may be set up in mobile applications with the user's consent. The data will not be kept beyond the navigation. The user can deactivate the GPS-tracking at any time. Depending on the services offered, such deactivation may hinder the working of the application.
In any case, the PIERRE ET VACANCES - CENTER PARCS Group entities undertake to process all data collected in a manner as to comply with the governing regulations and notably the aforementioned Regulation 2016/679.
b) Recipients of the collected data – availability of data to third parties
· Personal data collected on a Site or via a form is intended for the Site editor or the Form issuer (whose contact information is given in the Particulars or whose identity is specified in the data collection form) and where applicable, for official bodies and administrative or legal authorities as required by the Law.
In the case where the PIERRE ET VACANCES - CENTER PARCS Group entities entrust data processing activities to processors, such processors are also chosen based on their capacity to provide adequate guarantees regarding the implementation of appropriate technical and organisational measures, notably in terms of reliability and safety measures.

The PIERRE ET VACANCES - CENTER PARCS Group does not collect or keep personal data on users under 16 years of age without having obtained verifiable parental consent, on the understanding that the holders of parental authority may ask to receive the information relating to their child and to have it removed. On grounds of your specific situation, You may also oppose the processing of your personal data.
For non-necessary data that You have consented to provide and allow the processing, You have the right to withdraw your consent: the withdrawal of consent is not retroactive as regards the lawfulness of the processing conducted prior to said withdrawal.
You have the same right under the same terms and conditions on data specified as required at the time it was collected and that You authorised us to process for purposes other than the performance of the contract You are party to, or for carrying out measures prior to entering a contract, at your request.

ARTICLE 8 - SAFETY MEASURES
Given the technological changes, implementation costs, the nature of the data to be protected and the risks for the rights and freedoms of data subjects, the PIERRE ET VACANCES - CENTER PARCS Group implements all suitable technical and organisational measures to ensure the confidentiality, integrity, availability and resilience of the personal data collected and processed as well as a level of security appropriate to the risk.
